End-User License Agreement

1. Agreement and Parties

This EULA is a legal agreement between you ("User") and Fync ("we", "us", or "our"), the operator of the personal finance management application available at fync.money and m.fync.money. This agreement governs your use of the Fync software, website, and services.

2. License Grant

Subject to your compliance with this EULA and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Fync solely for your personal, non-commercial financial management purposes.

3. Free and Paid Plans

• Free Plan: allows you to create and manage up to 4 recurring transactions with core features available at no charge.
• Pro Plan: available for a subscription fee (currently $19.99/year), unlocking unlimited transactions and full access to all features. Subscription fees are billed through Stripe and are non-refundable except where required by applicable law.
• Pricing and features may change. We will provide reasonable notice of material changes to paid plan terms.

4. User Responsibilities

You agree to:

• Provide accurate information when creating your account.
• Keep your login credentials secure and not share them with others.
• Use Fync only for lawful purposes and in accordance with this EULA.
• Not attempt to reverse-engineer, decompile, or extract the source code of Fync.
• Not use Fync to store, process, or transmit any data on behalf of third parties for commercial gain.

5. Restrictions

You may not:

• Copy, modify, distribute, sell, or sublicense any part of Fync.
• Use automated scripts, bots, or scraping tools to access Fync.
• Attempt to gain unauthorized access to any systems or data.
• Use Fync in any way that violates applicable laws or regulations.

6. Your Data

You retain ownership of the financial data you enter into Fync. You grant us a limited license to store and process that data solely to provide the service to you. We do not use your financial data for advertising or sell it to third parties. See our Privacy Policy for full details.

7. Accuracy of Financial Information

Fync is a personal budgeting and tracking tool. It does not provide financial, tax, investment, or legal advice. All forecasts, summaries, and projections are estimates based on data you provide. You are solely responsible for the accuracy of information you enter and for any financial decisions you make.

8. Availability and Service Changes

We strive to keep Fync available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. For paid subscribers, we will provide a pro-rated refund in the event of permanent service discontinuation.

9. Disclaimer of Warranties

Fync is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that Fync will be error-free or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or financial loss, arising from your use of or inability to use Fync, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from this EULA shall not exceed the amount you paid for Fync in the 12 months preceding the claim.

11. Termination

This EULA is effective until terminated. You may terminate it at any time by deleting your account. We may terminate or suspend your access immediately, without prior notice, if you breach any term of this EULA. Upon termination, your right to use Fync ceases and we may delete your data in accordance with our Privacy Policy.

12. Governing Law

This EULA is governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada.

13. Changes to This EULA

We may update this EULA from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending an email notification. Continued use of Fync after changes take effect constitutes your acceptance of the revised terms.
